By downloading or using StrideStats, you agree to these terms. If you do not agree, do not use the app.
This agreement is between you and Bramhand Inc. only, and not with Apple Inc. Bramhand Inc., not Apple, is solely responsible for StrideStats and its content. By using StrideStats, you acknowledge that you have reviewed the Apple Media Services Terms and Conditions.
Bramhand Inc. grants you a personal, non-transferable, non-exclusive license to use StrideStats on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions (Usage Rules). This license does not allow you to use StrideStats on any device you do not own or control. You may use StrideStats through Family Sharing as permitted by Apple’s Usage Rules.
StrideStats is available for a one-time purchase through the App Store. Once purchased, you may use the app on all devices associated with your Apple ID (subject to Apple’s Family Sharing rules) without any recurring charges. Bramhand Inc. never sees your payment details — all transactions are handled by Apple.
StrideStats reads walking, running, and hiking workout data and step counts from Apple Health to display your activity history and statistics. By granting HealthKit access, you authorize StrideStats to read this data on your device. All processing occurs locally. StrideStats does not transmit your Health data anywhere.
StrideStats is a personal fitness statistics tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment recommendations.
Consult a qualified healthcare provider before starting, continuing, or changing an exercise program. You are responsible for exercising safely. Stop and seek help if you experience pain, dizziness, or discomfort.
Bramhand Inc. is solely responsible for providing maintenance and support services for StrideStats. Apple has no obligation to furnish any maintenance or support services with respect to StrideStats. Direct any questions or complaints to Bramhand Inc. at the contact information below.
Bramhand Inc. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event StrideStats fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for StrideStats to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to StrideStats, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Bramhand Inc.’s sole responsibility.
Bramhand Inc., not Apple, is responsible for addressing any claims by you or any third party relating to StrideStats or your possession and/or use of StrideStats, including but not limited to: (i) product liability claims; (ii) any claim that StrideStats fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that StrideStats or your possession and use of StrideStats infringes that third party’s intellectual property rights, Bramhand Inc., not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or designated as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using StrideStats.
You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this agreement, and that upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary thereof.
To the maximum extent permitted by law, Bramhand Inc. is not liable for any indirect, incidental, or consequential damages arising from use of the app, including any training decision made in reliance on app statistics.
These terms are governed by the laws of the State of Delaware, United States.
We may update these terms at any time. Continued use of the app constitutes acceptance of updated terms.
