By downloading or using VO2Stats, you agree to these terms. If you do not agree, do not use the app.
This agreement is between you and Bramhand Inc. only, and not with Apple Inc. Bramhand Inc., not Apple, is solely responsible for VO2Stats and its content. By using VO2Stats, you acknowledge that you have reviewed the Apple Media Services Terms and Conditions.
Bramhand Inc. grants you a personal, non-transferable, non-exclusive license to use VO2Stats on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions (Usage Rules). This license does not allow you to use VO2Stats on any device you do not own or control. You may use VO2Stats through Family Sharing or volume purchasing programs as permitted by Apple’s Usage Rules.
VO2Stats is a one-time paid purchase. There is no subscription, no recurring charge, no in-app purchases, and no advertising. You pay once and own the app.
VO2Stats is a personal wellness and fitness tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment recommendations.
Always consult a qualified healthcare provider before starting or changing an exercise routine, or when interpreting any fitness metric shown in the app, particularly if you have a medical condition.
VO2Stats calculates VO₂ max using several established, peer-reviewed methods. Each method’s formula, its primary reference, and its limitations are shown in the app under the Methods Guide tab, and are provided for transparency — they do not constitute personalized medical recommendations. Two representative references:
VO2Stats reads workouts, heart rate, resting heart rate, walking/running distance, active energy, step count, body weight, height, cardio fitness (VO₂ max), biological sex, and date of birth from Apple Health to compute your estimates entirely on-device. VO2Stats does not write any data back to Apple Health, and does not transmit any health data off your device.
Bramhand Inc. is solely responsible for providing maintenance and support services for VO2Stats. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to VO2Stats. Any questions or complaints regarding VO2Stats should be directed to Bramhand Inc. at the contact information below.
Bramhand Inc. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event VO2Stats fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for VO2Stats to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to VO2Stats, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Bramhand Inc.’s sole responsibility.
Bramhand Inc., not Apple, is responsible for addressing any claims by you or any third party relating to VO2Stats or your possession and/or use of VO2Stats, including but not limited to: (i) product liability claims; (ii) any claim that VO2Stats fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that VO2Stats or your possession and use of VO2Stats infringes that third party’s intellectual property rights, Bramhand Inc., not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using VO2Stats.
You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this agreement, and that upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary thereof.
To the maximum extent permitted by law, Bramhand Inc. is not liable for any indirect, incidental, or consequential damages arising from use of the app, including reliance on any VO₂ max estimate shown in the app.
These terms are governed by the laws of the State of Delaware, United States.
We may update these terms at any time. Continued use of the app constitutes acceptance of updated terms.
